Terms of service.

1. Agreement

These Terms (“Terms”) govern your use of Statman Medical Delivery of North Carolina LLC’s courier services (“Services”). By requesting or using Services, you agree to these Terms and our Privacy Policy.

2. Services

We provide medical courier services including specimen transport, device/supply delivery, records delivery, cold-chain logistics, and cryogenic transport (when you supply the charged canister and case).

3. Client Obligations

  • Provide accurate pickup/delivery details and any required labels (biohazard, dry-ice).
  • Warrant that all shipments comply with DOT, OSHA, HIPAA, and applicable regulations.
  • Supply cryogenic containers charged per manufacturer specs for vapor-phase shipments.
  • Ship only lawful and properly packaged items.

4. Scheduling & Cancellations

  • Bookings are subject to availability. STAT runs: 24/7, subject to courier proximity.
  • Cancellations or reschedules must be made ≥2 hours before scheduled pickup; otherwise, a fee up to 50% of the quoted rate may apply.

5. Fees & Payment

  • Fees are quoted per job based on mileage, time, temperature requirements, and service level.
  • Payment is due within 30 days of invoice or per quoted terms. Late payments incur 1.5% monthly interest.
  • We reserve the right to require a deposit or pre-payment for new clients or high-risk shipments.

6. Insurance & Liability

  • We carry $1,000,000 general liability and $100,000 motor-truck cargo insurance.
  • Our liability for loss or damage is limited to the lesser of:
    (a) actual shipment value
    (b) the cargo insurance limit.
  • We are not liable for indirect, incidental, or punitive damages, or delays due to events beyond our control (force majeure).

7. Indemnification

You agree to defend, indemnify, and hold us harmless from any third-party claims arising from your breach of these Terms or applicable laws.

8. Confidentiality & PHI

We maintain HIPAA-compliant procedures. Any Protected Health Information (“PHI”) you provide will be handled per our Privacy Policy and any signed Business Associate Agreement.

9. Termination

We may suspend or terminate Services (with or without notice) if you breach these Terms, owe undisputed fees, or ship prohibited items.

10. Governing Law & Dispute Resolution

These Terms are governed by North Carolina law, excluding conflict-of-law rules. Any dispute shall be submitted to binding arbitration in Raleigh, NC under the AAA Commercial Rules.

11. Changes to Terms

We may modify these Terms at any time; changes apply to bookings made after the “Last updated” date. Continued use constitutes acceptance.
